The Circuit Clerk’s office handles judicial foreclosures (a court ordered sale of property)
and court-appointed sale of properties.

The Circuit Clerk’s office does NOT handle non-judicial foreclosures (no court order.) These are
posted by the front door of the courthouse.

Foreclosure of Property

• The Circuit Clerk will offer to the public property designated by the Circuit Court to sell at auction.

• The Circuit Clerk will sell the designated property to the highest bidder.

• Sales will be located at the courthouse designated in the court order.

• The terms of sale are on located in The Notice of Sale for each property.

Foreclosure Guidelines

• Any individual interested in bidding on and/or purchasing a property may complete a title/record search if desired. THE CIRCUIT CLERK’S OFFICE DOES NOT PERFORM TITLE/LIEN SEARCHES.

• Property is sold as is with no warranty.

• Sales will be located at the courthouse designated in the court order.

• The Circuit Clerk’s office, Circuit Clerk, or member of the clerk’s staff does not provide legal advice.

• Potential bidders shall, prior to start of sale, provide a letter of credit on a financial institution letterhead. Bidder must pay 10% of purchase price at the time of sale with balance payable to
  the commissioner, plus interest, within 90 days of sale. Other terms may apply as listed in the notice of sale.
